Terms of Use — Circle

Circle ("the App") is a game published by ZINKEY LLC ("Zinkey Labs", "we", "us"). By installing or using the App you accept these terms. If you do not accept them, do not use the App.

What Circle is

Circle simulates a social network populated by fictional characters written by a language model. Nothing those characters say, post or send you comes from a real person. Any resemblance to existing people would be coincidental.

Replies are generated automatically. They can be inaccurate, inconsistent or inappropriate. They are not advice, not reliable information, and not the opinion of the publisher.

Age

The App is intended for people aged 17 and over. Generated content may touch on themes intended for an adult audience.

Your games

No online account with your name or email is created. Your profiles, your worlds and your messages are saved on your phone only, except a world you choose to share with the community. Uninstalling the App or clearing its data deletes them permanently, and we cannot restore them. Your daily energy, your Circle+ subscription and the worlds you share are held on our server against an anonymous device key, as described in the Privacy Policy.

Acceptable use

You agree not to use the App:

• to produce, distribute or attempt to obtain unlawful content, in particular content involving minors, incitement to hatred or violence, or the harassment of a real person;
• to impersonate a real, identifiable person in a way that could harm them, or to put a real, identifiable person or their photo in a world you share;
• to circumvent the protections of the App, of our servers or of the model provider, or to automate access to them;
• to reproduce, resell or make the service available to third parties.

We may suspend access to the service for a device that breaches these rules, and remove any world it shared.

Zero tolerance

We have zero tolerance for objectionable content and abusive users. Sexually explicit content is forbidden everywhere in the App: in characters, in worlds, in photos and in what you write. Hateful, threatening or graphically violent content is forbidden too.

Every character and every world you create is checked automatically before it is saved, its texts and its photo included; what the check refuses is not kept. The characters of the game are instructed never to write sexually explicit content.

Generated content

The characters write freely from the world you chose or created. You remain responsible for what you write, for the characters you create and for the worlds you create. If a generation produces something that should not have appeared, tell us at support@zinkeylabs.com; it helps us adjust the game's guardrails.

Worlds shared with the community

You may share a world you created with the other players. By sharing it, you confirm that you have the right to publish its name, description, cover, characters and photos, and you grant ZINKEY LLC a free, non-exclusive, worldwide licence to host, reproduce, adapt to the App (for example by resizing images) and show that content to other players, for as long as the world is offered in the App. You keep your rights over what you wrote.

Every shared world is checked automatically, then reviewed by us before it is listed. We may refuse or remove any world, at any time and without notice, in particular when it breaks the rules above or the rights of others. Other players play in it with their own profiles: what the characters write for them is generated, and is not written by you.

Any player can report a community world from the App, or hide every world of its creator without reporting anything; a report hides them as well. We review every report within 24 hours. When a world breaks these rules, we remove it and the other worlds of its creator from the community, and we may suspend access to the service for the device that shared them. If you hold rights over content shown in a world, write to support@zinkeylabs.com with its name; we remove content that infringes the rights of others once we are made aware of it.

Daily energy and Circle+

What the characters write draws on a daily energy gauge, refilled every day for free. Circle+ is an optional auto-renewing subscription that multiplies that energy, sold monthly or yearly through the App Store or Google Play. Payment is charged to your store account when you confirm the purchase; the subscription renews automatically unless cancelled at least 24 hours before the end of the current period, and is managed and cancelled in your store account settings. Prices, renewal, cancellation and refunds are set out on the Circle+ page, which forms part of these terms.

Intellectual property

The App, its name, its design and its code belong to the publisher. The text you write remains yours. Content generated by the model from your actions may be used by you for personal purposes.

Liability

The App is provided "as is". We do not guarantee its availability, the absence of errors, or the quality of generated content. To the extent permitted by law, we cannot be held liable for indirect damage arising from use of the App. Nothing in these terms limits the rights you hold as a consumer under applicable law.

Changes

These terms may change. The date at the top of this page indicates the latest version. Continuing to use the App after a change constitutes acceptance of it.

The App runs on your device; generated content comes from language models reached through OpenRouter; characters and worlds are checked by OpenAI's moderation before they are saved; payments are processed by Apple (App Store) and Google (Google Play); daily energy, subscription status and community worlds are hosted on Neon.

Governing law

These Terms are governed by applicable law. Mandatory consumer-protection provisions of your country of residence remain applicable to you.
